This Agreement is public, i.e. in accordance with Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers regardless of their status (individual, legal entity, individual entrepreneur) without giving preference to one buyer over another. By entering into this Agreement, the Buyer fully accepts the terms and conditions and the procedure for placing an order, paying for the goods, delivering the goods, returning the goods, liability for a bad faith order and all other terms of the Agreement. The Agreement is considered concluded from the moment the Buyer clicks the \u00abCheckout\u00bb button on the checkout page in the \u00abCart\u00bb section and receives an order confirmation from the Seller in electronic form.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a58e4e elementor-widget elementor-widget-heading\" data-id=\"1a58e4e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">1. Definition of terms<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-34cac13 color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"34cac13\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>1.1. Public Offer (hereinafter referred to as the \u00abOffer\u00bb) is a public offer of the Seller addressed to an indefinite number of persons to conclude a contract for the sale of goods remotely with the Seller (hereinafter referred to as the \u00abAgreement\u00bb) on the terms and conditions contained in this Offer.<br><span style=\"font-size: 14px;\"><br>1.2. Goods or Services - the object of the parties' agreement, which was selected by the Buyer on the website of the Online Store and placed in the basket, or already purchased by the Buyer from the Seller remotely.<br><\/span><span style=\"font-size: 14px;\"><br>1.3. Online store - the Seller's website at https:\/\/glamu.com.ua\/ is created for the conclusion of retail sales contracts on the basis of the Buyer's familiarization with the description of the Goods offered by the Seller via the Internet.<br><\/span><span style=\"font-size: 14px;\"><br>1.4. The Buyer is a legally capable individual who has reached the age of 18, receives information from the Seller, places an order for the purchase of goods presented on the website of the Online Store for purposes not related to the conduct of entrepreneurial activity, or a legal entity or individual entrepreneur.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c3053f3 elementor-widget elementor-widget-heading\" data-id=\"c3053f3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">2. Subject of the Agreement<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-591bc91 color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"591bc91\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>2.1. The Seller undertakes to transfer the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods on the terms of this Agreement.<br \/><span style=\"font-size: 14px;\"><br \/>2.2. The date of the conclusion of the Offer Agreement (acceptance of the offer) and the moment of full and unconditional acceptance by the Buyer of the terms of the Agreement shall be the date of receipt by the Buyer of the order confirmation from the Seller in electronic form.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a7f0417 elementor-widget elementor-widget-heading\" data-id=\"a7f0417\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">3. Placement of the Order<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-77a658c color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"77a658c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>3.1. The buyer independently places an order in the online store through the \u00abShopping cart\u00bb form, or by placing an order on Instagram or by calling the phone number indicated in the contacts section of the online store.<br><span style=\"font-size: 14px;\"><br>3.2. The Seller has the right to refuse to transfer the order to the Buyer if the information provided by the Buyer when placing the order is incomplete, false or suspicious of their validity.<br><\/span><span style=\"font-size: 14px;\"><br>3.3 When placing an order on the website of the online store, the Buyer undertakes to provide the following mandatory information required by the Seller to fulfill the order:<br><\/span><span style=\"font-size: 14px;\"><br>3.3.1. surname, name of the Buyer;<br><\/span><span style=\"font-size: 14px;\"><br>3.3.2. the address to which the Goods should be delivered (if delivered to the Buyer's address);<br><\/span><span style=\"font-size: 14px;\"><br>3.3.3. contact phone number.<br><\/span><span style=\"font-size: 14px;\"><br>3.3.4. e-mail address.<br><\/span><span style=\"font-size: 14px;\"><br>3.4. The name, quantity, article, price of the Goods selected by the Buyer are indicated in the Buyer's basket on the website of the Online Store.<br><\/span><span style=\"font-size: 14px;\"><br>3.5. If either Party to the Agreement requires additional information, it has the right to request it from the other Party. In case of failure to provide the necessary information by the Buyer, the Seller is not responsible for providing quality services to the Buyer when purchasing goods in the online store.<br><\/span><span style=\"font-size: 14px;\"><br>3.6. When placing an order through the Seller's operator (clause 3.1. of this Offer), the Buyer undertakes to provide the information specified in clauses 3.3 - 3.4. of this Offer.<br><\/span><span style=\"font-size: 14px;\"><br>3.7. The Buyer's acceptance of the terms of this Offer is carried out by the Buyer entering the relevant data in the registration form on the website of the online store or when placing an Order through the operator. After placing an Order through the Operator, the Buyer's data is entered into the Seller's database.<br><\/span><span style=\"font-size: 14px;\"><br>3.8. The buyer is responsible for the accuracy of the information provided when making<br><\/span><span style=\"font-size: 14px;\"><br>3.9. By entering into the Agreement, i.e. accepting the terms of this offer (the proposed terms of purchase of the Goods), by placing an Order, the Buyer confirms the following:<br><\/span><span style=\"font-size: 14px;\"><br>\u0430) The Buyer is fully and completely familiarized with and agrees to the terms of this offer;<br><\/span><span style=\"font-size: 14px;\"><br>b) he\/she authorizes the collection, processing and transfer of personal data, the permission to process personal data is valid for the entire term of the Agreement, as well as for an unlimited period after its expiration.<br><\/span><span style=\"font-size: 14px;\"><br>In addition, by entering into the Agreement, the Buyer confirms that he has been notified (without additional notice) of the rights established by the Law of Ukraine \u201cOn Personal Data Protection\u201d, of the purposes of data collection, and that his personal data is transferred to the Seller in order to fulfill the terms of this Agreement, to make mutual settlements, and to receive invoices, acts and other documents.<br><\/span><span style=\"font-size: 14px;\"><br>The Seller has the right to transfer personal data to third parties only to the extent necessary to fulfill the Buyer's order (in particular, to logistics companies and payment services) in accordance with the Law of Ukraine \u00abOn Personal Data Protection\u00bb.<br><\/span><span style=\"font-size: 14px;\"><br>The scope of the Buyer's rights as a subject of personal data in accordance with the Law of Ukraine \u201cOn Personal Data Protection\u201d is known and understood by him\/her.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-efb7e9f elementor-widget elementor-widget-heading\" data-id=\"efb7e9f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">4. Price and Delivery of the Goods<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f354adb color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"f354adb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>4.1 The prices for the Goods and Services are determined by the Seller independently and are indicated on the website of the Online Store. All prices for the Goods and Services are indicated on the website in UAH including VAT.<br \/><span style=\"font-size: 14px;\"><br \/>4.2 Prices for Goods and services may be changed by the Seller unilaterally depending on market conditions. At the same time, the price of a separate unit of the Goods, the cost of which has been paid by the Buyer in full, cannot be changed by the Seller unilaterally.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>4.3. The cost of the Goods indicated on the website of the Online Store does not include the cost of delivery of the Goods to the Buyer. The Buyer pays the cost of delivery of the Goods in accordance with the current tariffs of delivery services (carriers) directly to the delivery service (carrier) chosen by him.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>4.4. The cost of the Goods indicated on the website of the Online Store does not include the cost of delivery of the Goods to the Buyer's address.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>4.5. The Seller may indicate the approximate cost of delivery of the Goods to the Buyer's address when the Buyer contacts the Seller with a request by sending an e-mail or when placing an order through the operator of the online store.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>4.6. The Buyer's obligations to pay for the Goods shall be considered fulfilled from the moment the Seller receives funds to its account.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>4.7. Settlements between the Seller and the Buyer for the Goods shall be made in the manner specified on the website of the Online Store in the section \u00abPayment and Delivery\u00bb.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>4.8. Upon receipt of the goods, the Buyer shall, in the presence of a representative of the delivery service (carrier), check the compliance of the Goods with the qualitative and quantitative characteristics (name of the goods, quantity, completeness).<br \/><\/span><span style=\"font-size: 14px;\"><br \/>4.9. Upon acceptance of the Goods, the Buyer or his\/her representative shall confirm with his\/her signature in the sales receipt\/ or in the order\/ or in the consignment note for the delivery of goods that he\/she has no claims to the quantity of goods, appearance and completeness of the goods.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>4.10. The ownership and risk of accidental loss or damage to the Goods shall be transferred to the Buyer or his Representative from the moment of receipt of the Goods by the Buyer in the place of delivery of the Goods upon self-delivery of the Goods from the Seller, or upon transfer of the Goods by the Seller to the delivery service (carrier) chosen by the Buyer.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ad2e80 elementor-widget elementor-widget-heading\" data-id=\"1ad2e80\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">5. Rights and obligations of the Parties<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b8cbaea color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"b8cbaea\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>5.1. The seller is obliged to:<br \/><span style=\"font-size: 14px;\"><br \/>5.1.1. Transfer the goods to the Buyer in accordance with the terms of this Agreement and the Buyer's order.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>5.1.2. Not to disclose any private information about the Buyer and not to provide access to this information to third parties, except as provided by law and during the execution of the Buyer's Order.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>5.2. The seller has the right to:<br \/><\/span><span style=\"font-size: 14px;\"><br \/>5.2.1 To change the terms of this Agreement, as well as the prices for the Goods and services, unilaterally by posting them on the website of the Online Store. All changes shall take effect from the moment of their publication.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>5.3. The Buyer undertakes:<br \/><\/span><span style=\"font-size: 14px;\"><br \/>5.3.1. Prior to the conclusion of the Agreement, familiarize yourself with the content of the Agreement, the terms of the Agreement and the prices offered by the Seller on the website of the Online Store.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>5.3.2. In order to fulfill the Seller's obligations to the Buyer, the latter must provide all the necessary data that uniquely identify him as the Buyer and are sufficient to deliver the ordered Goods to the Buyer.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6368d96 elementor-widget elementor-widget-heading\" data-id=\"6368d96\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">6. Return of the Goods<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e89ee06 color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"e89ee06\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>6.1. After purchasing a product on the website https:\/\/glamu.com.ua\/, you can return it within 60 days if it does not suit you for any reason. This return period exceeds the minimum guaranteed by the Law of Ukraine \u00abOn Consumer Protection\u00bb 14-day period and is an additional guarantee from the store.<br \/><span style=\"font-size: 14px;\"><br \/>6.3. Returns of goods with a defect or manufacturing defect are made as a result of a service center report. The return is possible only if the service center determines that the goods are not defective:<br \/><\/span><span style=\"font-size: 14px;\"><br \/>- has a defect caused by the manufacturer's fault;<br \/><\/span><span style=\"font-size: 14px;\">- It is returned during the warranty period.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.4. The Buyer may receive a refusal from the service center to provide warranty service if:<br \/><\/span><span style=\"font-size: 14px;\"><br \/>- the goods have mechanical or other damage caused by the negligence of the buyer or third parties;<br \/><\/span><span style=\"font-size: 14px;\">- the buyer has used the goods incorrectly;<br \/><\/span><span style=\"font-size: 14px;\">- the buyer has made unauthorized disclosure of the goods, attempted to repair or correct them on their own, or changed internal communications, components, or circuits;<br \/><\/span><span style=\"font-size: 14px;\">- the buyer has violated the safety and damaged the warranty seals;<br \/><\/span><span style=\"font-size: 14px;\">- the serial number or MAC address stored in the product memory has been altered, erased, or damaged and cannot be set;<br \/><\/span><span style=\"font-size: 14px;\">- damage has been detected that has occurred as a result of foreign objects, substances, liquids, insects getting inside the product, or the product has been exposed to extreme temperatures, which has led to a violation.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.5. Return\/exchange of goods is carried out by the delivery service \u00abNova Poshta\u00bb.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.6. All costs associated with the return\/exchange of goods of good quality shall be borne by the buyer.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.7. If within 14 (fourteen) calendar days from the date of receipt of the goods a significant defect (latent defect) is detected, the goods shall be accepted by the seller for repair or exchange, and if they are not possible - for a refund.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>In this case, the goods are returned by the Nova Poshta delivery service, and all costs associated with the delivery of goods of inadequate quality are borne by the seller.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.8. Returns and exchanges of goods are carried out throughout Ukraine, where it is possible today. To make a return, please call our hotline.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.9. Refunds:<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.9.1 Upon receipt of the goods and confirmation that the requirements for the returned goods have been met, we will issue a refund.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.9.2 Refunds shall be made by transfer to the buyer's card account no later than 7 (seven) business days from the date of receipt by the seller of the returned goods and confirmation of compliance with the terms of the return of the goods by the buyer.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>6.9.3 When refunding funds to the buyer's bank card, the time of receipt of funds to the buyer's account may depend on the policy of the bank institution that issued the card.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2e04de3 elementor-widget elementor-widget-heading\" data-id=\"2e04de3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">7. Responsibility<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5b8dca4 color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"5b8dca4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>7.1. The Seller shall not be liable for any damage caused to the Buyer or third parties in connection with the violation of the storage conditions of the goods after their transfer to the Buyer or the delivery service, if such violation occurred through no fault of the Seller.<br \/><span style=\"font-size: 14px;\"><br \/>7.2. The Seller shall not be liable for improper, untimely fulfillment of the Orders and its obligations in case the Buyer provides false or misleading information.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>7.3. The Seller and the Buyer shall be responsible for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>7.4. The Seller or the Buyer shall be released from liability for full or partial failure to fulfill their obligations if the failure is the result of force majeure such as war or hostilities, earthquake, flood, fire and other natural disasters that have arisen regardless of the will of the Seller and\/or the Buyer after the conclusion of this agreement. The Party that is unable to fulfill its obligations shall immediately notify the other Party thereof.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0b035cf elementor-widget elementor-widget-heading\" data-id=\"0b035cf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">8. Confidentiality and protection of personal data.<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2cf2d0f color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"2cf2d0f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>8.1. By providing his personal data on the website of the online store when registering or placing an Order, the Buyer gives the Seller his voluntary consent to the processing, use (including transfer) of his personal data, as well as to perform other actions provided for by the Law of Ukraine \u00abOn Personal Data Protection\u00bb, without limiting the validity of such consent.<br \/><span style=\"font-size: 14px;\"><br \/>8.2. The Seller undertakes not to disclose the information received from the Buyer. It shall not be considered a violation if the Seller provides information to counterparties and third parties acting on the basis of an agreement with the Seller, including for the fulfillment of obligations to the Buyer, as well as in cases where the disclosure of such information is established by the requirements of the current legislation of Ukraine.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>8.3. The Buyer is responsible for keeping their personal data up to date. The Seller is not responsible for poor performance or failure to fulfill its obligations due to the irrelevance of information about the Buyer or its inconsistency with reality.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-69f5a5d elementor-widget elementor-widget-heading\" data-id=\"69f5a5d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">9. 9. Other conditions<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9949e29 color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"9949e29\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>9.1 This Agreement is concluded on the territory of Ukraine and shall be valid in accordance with the current legislation of Ukraine.<br \/><span style=\"font-size: 14px;\"><br \/>9.2. All disputes arising between the Buyer and the Seller shall be resolved through negotiations. In case of failure to resolve the dispute through negotiations, the Buyer and\/or the Seller shall have the right to apply to the judicial authorities in accordance with the current legislation of Ukraine.<br \/><\/span><span style=\"font-size: 14px;\"><br \/>9.3. The Seller shall have the right to amend this Agreement unilaterally as provided for in clause 5.2.1. of the Agreement.
